What was filed

New Mexico announced a federal civil action on October 21, 2026 against Darren K. Indyke, Epstein’s longtime lawyer, and Richard D. Kahn, his accountant. The estate and the 1953 Trust are also named. The state alleges that the men financed, facilitated and concealed trafficking, including conduct connected with Zorro Ranch.[S12]
The complaint is document 1 in case 1:26-cv-03543. The allegations are the state’s claims to be tested in litigation, not findings that the defendants are guilty or liable.[S13]
The response belongs beside the allegation

Their lawyer Daniel Weiner denied that the men knowingly facilitated the abuse. Reuters reported his position that neither witnessed or participated in it and his criticism that the state had not interviewed them before filing the action.[S14]
This dispute is therefore not fairly described as a new conviction or as a proven account of what the men knew. The state alleges knowing assistance, and the defense contests it.
Estate payments and requested relief

The complaint describes potential bequests of $50 million for Indyke and $25 million for Kahn, subject to available funds. It seeks payment restrictions and other remedies. Requested relief is not relief already granted.[S13]
The announcement also says a separate criminal investigation remains ongoing. The civil filing should not be rewritten as a criminal indictment.[S12]
The questions this case can test

The central reporting task is to follow the evidence connecting particular financial decisions to alleged knowledge and assistance. Control over an account is one fact. What the account holder knew and authorized is another. A careful account must establish the connection instead of assuming it.
Further coverage should distinguish a defense filing, a ruling on whether claims may proceed, an order protecting assets and an eventual decision on liability. Each would change the procedural story in a different way.
